Athlete House Trainer Agreement
Effective Date: June 1, 2026
PLEASE READ THIS TRAINER AGREEMENT CAREFULLY. IT CONTAINS IMPORTANT PROVISIONS REGARDING YOUR INDEPENDENT CONTRACTOR STATUS, SAFETY OBLIGATIONS, PAYMENT TERMS, AND BINDING ARBITRATION.
This Trainer Agreement ("Agreement") is entered into between Athlete House LLC ("Athlete House") and you as an independent trainer on the Athlete House platform. By accepting this Agreement, you agree to all terms and conditions contained herein.
1. Purpose
Athlete House operates an online marketplace that connects athletes, parents, and sports participants ("Clients") with independent athletic trainers, coaches, and instructors.
This Agreement governs your participation as a Trainer on the Athlete House platform. Athlete House reserves the right to modify this Agreement at any time. Trainer will be notified of material changes via email or platform notification. Continued use of the platform after changes constitutes acceptance of the modified Agreement.
2. Independent Contractor Status
You are an independent contractor, not an employee, agent, partner, or joint venturer of Athlete House. You expressly acknowledge and agree:
• You control the manner, methods, and means of performing your services.
• You set your own hours, rates, and training methodologies.
• Athlete House does not supervise, direct, or control your training sessions.
• You are solely responsible for your own tax obligations (including self-employment taxes), insurance coverage, business expenses, certifications, licenses, and compliance with applicable laws.
• You are not entitled to any employee benefits from Athlete House, including but not limited to health insurance, retirement plans, paid leave, or workers' compensation.
• This Agreement does not create any employment relationship, agency, partnership, or joint venture between you and Athlete House.
The economic reality of this relationship is that of an independent business contracting with a technology marketplace platform. Both parties agree this classification is accurate and appropriate.
3. Platform Access and Account Requirements
To participate as a Trainer on the Athlete House platform, you must:
• Be at least 18 years of age.
• Provide accurate and complete information during registration and maintain updated account information.
• Complete the Athlete House verification process, including providing any requested documentation.
• Authorize and cooperate with background check screenings as required by Athlete House.
• Accept and comply with all current and future Athlete House policies, including this Agreement, the Terms of Service, and the Privacy Policy.
• Maintain a valid Stripe Connect account for payment processing.
• Complete Stripe onboarding before receiving payouts.
Your account access may be suspended or terminated if you fail to meet any of these requirements.
4. Background Checks and FCRA Compliance
By accepting this Agreement, you expressly authorize Athlete House to obtain consumer reports (background checks) on you through third-party consumer reporting agencies in compliance with the Fair Credit Reporting Act (FCRA), 15 U.S.C. § 1681 et seq.
You understand and acknowledge:
• Background checks may be conducted at initial application and periodically thereafter.
• Before any background check is conducted, you will receive a separate written disclosure and authorization form.
• You will receive a copy of the FCRA "Summary of Your Rights" before any adverse action is taken.
• If Athlete House intends to take adverse action (including restricting or terminating your account) based on background check results, you will receive a pre-adverse action notice and opportunity to respond.
• A passed background check does not guarantee permanent platform access and is not an endorsement by Athlete House.
• You must immediately notify Athlete House of any criminal charge, conviction, or legal proceeding that may affect your eligibility to work with youth athletes.
Background check results are treated as confidential and handled in accordance with the Athlete House Privacy Policy and applicable law.
5. Youth Athlete Safety Requirements
Because Athlete House serves youth athletes, you agree to comply with the following mandatory safety requirements:
MANDATORY SAFETY STANDARDS
• You must never be alone with a minor athlete in a non-public setting. All training of minors must occur in open, visible environments.
• You must immediately report any suspected abuse, neglect, or exploitation of a minor athlete to appropriate authorities and to Athlete House.
• You must maintain appropriate professional boundaries with all athletes, with particular attention to interactions with minors.
• You may not communicate with minor athletes through personal contact information, social media, or private messaging outside of the Athlete House platform without documented parental consent.
• You must ensure your training facilities and methods are safe and appropriate for the age and physical development of the athletes you train.
PROHIBITED CONDUCT
• Physical, emotional, or sexual abuse or exploitation of any athlete.
• Use of prohibited performance-enhancing substances or encouragement of their use.
• Any form of discrimination based on race, sex, religion, national origin, disability, or any other protected characteristic.
• Conduct unbecoming of a professional trainer or that brings disrepute to Athlete House.
MANDATORY REPORTING
You are required to report to Athlete House within 24 hours any incident involving injury, safety concern, inappropriate conduct, or potential legal liability arising from your training activities.
Violation of these safety requirements is grounds for immediate account suspension and may be reported to law enforcement or child protective services.
6. Insurance Requirements
You are required, at your own expense, to obtain and maintain adequate insurance for the services you provide. This must include, at minimum:
• Commercial General Liability insurance with limits of not less than $1,000,000 per occurrence and $2,000,000 in the aggregate.
• Professional Liability (Errors & Omissions) insurance.
• Sexual Abuse and Molestation (SAM) coverage where available and appropriate.
Upon request, you must provide Athlete House with a certificate of insurance evidencing the required coverage and naming Athlete House LLC as an additional insured. Failure to maintain required insurance is grounds for suspension of your platform access.
You acknowledge that Athlete House does not provide you with any insurance coverage.
7. Platform Fee Structure and Payment Terms
By accepting this Agreement, you acknowledge and agree to the following fee structure:
PLATFORM SERVICE FEE
Athlete House charges a platform service fee on all bookings processed through the platform. The current fee structure is disclosed on the platform and may be updated with notice.
ONE-TIME SETUP FEE
A one-time platform setup fee of $30.00 USD is charged upon your first successful booking through the platform. This fee covers account activation, verification processing, and platform onboarding.
PAYMENT PROCESSING
• All payments from Clients must be processed exclusively through the Athlete House platform and Stripe payment system.
• Payouts to your connected Stripe account are subject to Stripe's processing timelines and the Athlete House payout schedule.
• Athlete House may withhold, delay, or reverse payouts in cases of suspected fraud, chargebacks, refund disputes, safety concerns, or violations of this Agreement.
• You are responsible for all taxes on income earned through the platform.
PROHIBITED PAYMENT ARRANGEMENTS
You may not solicit or accept payment from Clients for services booked through the Athlete House platform outside of the Athlete House payment system. Circumventing the platform payment system is a material breach of this Agreement and grounds for immediate termination.
8. Mandatory Platform-Only Booking
All bookings for services offered through the Athlete House platform must be processed exclusively through the Athlete House platform.
You expressly agree that you will not:
• Solicit Clients from the Athlete House platform to book sessions directly with you outside the platform.
• Accept payment for Athlete House-referred services through any method other than the Athlete House payment system.
• Encourage Clients to circumvent the platform for bookings.
• Share personal payment information (Venmo, PayPal, Zelle, etc.) with Clients for platform-referred sessions.
Violation of this section is a material breach of this Agreement and may result in immediate account termination and potential legal action to recover platform fees owed.
9. Professional Standards and Conduct
As an Athlete House Trainer, you represent the Athlete House brand and must maintain high professional standards. You agree to:
• Respond to booking requests and client inquiries in a timely and professional manner.

You acknowledge that providing athletic training services involves inherent risks, including physical injury to athletes in your care. You voluntarily assume all risks associated with your training activities and are solely responsible for the safety and well-being of athletes during your training sessions.
